Trademark Revision/Rectification
Trademark rectification is needed when the trademark application has been filed with some mistakes or the trademark examiner makes an mistake in reviewing it.
When the Trademark application is submitted, it is first examined by the trademark examiner for primacy concerns in the form of a formality check. If any concerns are noted on the Trademark application, the Examiner would mark the application as Formalities Check Fail and request rectification of the trademark application. In such a cases, both the examiner and the agent/attorney/applicant might have made a mistake. Once the formality check failed has been updated on the application, the agent/attorney/applicant has to either correct the mistake and re-submit the application or reply the formality check fail status with a decent reply notifying if the examiner is making a mistake in examining it.
In such a case, when the Trade Mark Registrar marks the application as Formalities Chk Fail or Send Back to EDP, the applicant has an opportunity to rectify and resubmit the trademark application. The applicant needs to submit the rectification deed to the Trademark Examiners. This rectification deed need to be prepared on factual basis to support the request. If the Trademark Examiner finds the rectification sufficient and addresses all the concerns raised by him/her, application is allowed to be processed and marked for examination by a Trademark Examiner for preparing Trademark Examination Report.
